These Terms of Service ("Terms") govern the use of Publiweb, an application developed by Bruno Borges. By installing, accessing or using Publiweb, you agree to these Terms and to the Publiweb Privacy Policy. If you do not agree, do not use the application.
Publiweb is a module of a website with an online store. It automatically:
identifies promotions and discounts registered in the online store;
creates advertisements based on those promotions;
publishes the ads through the store's TikTok for Business advertising account; and
measures ad results through the TikTok Pixel and the TikTok Events API.
Publiweb is intended for store owners and businesses ("Users") who are at least 18 years old and legally able to enter into contracts. By using it, you confirm that you have authority to act on behalf of the store and of the TikTok advertising account connected to the application.
To publish ads, the User must connect a TikTok for Business account and authorize Publiweb to access it.
Publiweb uses this access only to create, publish, manage and measure the store's ads.
The User may disconnect the TikTok account at any time, which stops automatic publishing.
Use of TikTok is also subject to TikTok's own terms, advertising policies and community guidelines. Publiweb is not affiliated with, endorsed by or sponsored by TikTok.
The User is solely responsible for:
the accuracy of prices, discounts, product information and promotion conditions published in the store and in the ads;
making sure that the products and promotions comply with applicable law, including the Brazilian Consumer Protection Code (CDC), and with TikTok's advertising policies;
having the rights to all images, texts, trademarks and other content used in the ads;
displaying a cookie consent banner and a privacy policy to store visitors, as required by the LGPD;
paying all advertising costs charged by TikTok, which are billed directly by TikTok to the User's advertising account;
keeping access credentials secure and not sharing them with unauthorized persons.
The User must not use Publiweb to:
advertise illegal, counterfeit or prohibited products or services;
publish false, misleading or abusive promotions;
infringe intellectual property, privacy or other rights of third parties;
attempt to access, copy, reverse engineer or interfere with the application or its infrastructure;
violate TikTok's terms or advertising policies.
Publiweb publishes ads automatically based on the promotions registered in the store. The User should review the automatic publishing settings and the promotions before activating them. Publiweb does not guarantee that TikTok will approve, display or deliver any ad, nor any specific result in reach, clicks or sales.
Any fees for using Publiweb, if applicable, will be informed to the User before contracting. Advertising costs charged by TikTok are separate and are the User's responsibility.
Publiweb, including its software, design and documentation, belongs to Bruno Borges. The User receives a limited, non-exclusive, non-transferable license to use the application while these Terms are in effect. Content provided by the User (products, images, texts and trademarks) remains the User's property, and the User grants Publiweb permission to use it only to create and publish the store's ads.
The processing of personal data through Publiweb is described in the Publiweb Privacy Policy. Regarding the store's customer data, the User acts as the data controller and Publiweb acts as a data processor, under the Brazilian General Data Protection Law (LGPD – Law No. 13,709/2018).
We strive to keep Publiweb available, but we do not guarantee uninterrupted or error-free operation. The service may be suspended for maintenance, updates or due to changes or outages in TikTok's services and APIs. Features may be added, changed or removed at any time.
To the extent permitted by law, Publiweb and its developer are not liable for:
indirect damages, loss of profits or loss of data;
ads rejected, removed or restricted by TikTok, or suspension of the User's TikTok account;
errors in prices, discounts or information registered by the User;
failures or changes in third-party services, including TikTok and the e-commerce platform.
The User may stop using Publiweb at any time by disconnecting the TikTok account and uninstalling the module. We may suspend or terminate access if these Terms, the law or TikTok's policies are violated. After termination, data will be handled as described in the Privacy Policy.
These Terms may be updated from time to time. The date at the top indicates the current version. Continued use of Publiweb after changes means acceptance of the updated Terms.
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Porto Alegre, State of Rio Grande do Sul, Brazil, shall have jurisdiction over any disputes, except where the law provides otherwise for consumers.
